A divorce is the legal dissolution of a marriage. Sound complicated? Put simply, this means that the courts recognise that you are no longer married and no longer have the rights and obligations attached to a marriage.
The Legal Requirements of Divorce
There are four legal requirements to a divorce:
You must have (1) a marriage, (2) which is broken down irretrievably, (3) as evidenced by 12 months separation. Finally, there must be (4) no likelihood of resuming relationship and cohabitation.
Divorce has many impacts and so must be considered carefully. Just as marriage should never be considered lightly, neither should divorce. The implications of divorce can include:
- Division of assets (otherwise known as ‘property settlement’), or
- Parenting arrangements – divorce does not change parental responsibility.
