Different dispute resolution processes may be more or less useful in reaching a conclusion in your family law property settlement. This blog post looks at the ‘what’ and ‘why’ of mediation.

What is mediation?

Mediation is a form of dispute resolution. The parties to the dispute sit down with an impartial mediator and try and resolve the dispute. Both parties will usually come with a list a talking points and the mediator will attempt to manage discussion between parties so that some or all of these points can be resolved.

Why choose mediation?

Mediation is helpful if the parties require an impartial third party to conduct the negotiation process. It is effectively a formal negotiation process and will help parties reach an outcome agreed upon by both.

Mediation is not helpful when there is a significant power imbalance between the parties, a party does not wish to reach a resolution, parties struggle to communicate or a party has not disclosed information required to have an informed discussion.
