What is changing?
From 29 April 2016 all properties in NSW with a swimming pool or spa pool cannot be sold or leased without a valid certificate of compliance or relevant occupation certificate. Local councils and accredited private certifiers can provide information on how to obtain a certificate.
If you are selling a property which contains a swimming pool or spa, the contract of sale must attach a valid swimming pool certificate of compliance/a relevant occupation certificate issued within the last three years and a certificate of registration.
How do you comply?
Swimming pools and spas can be registered at: http://www.swimmingpoolregister.nsw.gov.au/
Swimming pools and spas can be inspected through your local council and other accredited certifiers. This should be done now to avoid any delay in the sale of your property.
Who is responsible?
Owners are responsible for registration and compliance for private properties. If your property is within a strata complex, retirement village, community scheme or multi-occupancy development, it is usually the responsibility of the owners’ corporation or body corporate to arrange for certification and registration of the common property pool.
