Family Law: How to...lodge an Initiating Application in Property Matters

An Initiating Application is the document you file if you want to start Family Law Court proceedings for a property settlement

An Initiating Application is the document you file if you want to start Court proceedings. Whilst Court should be an avenue of last resort, it is sometimes necessary to bring proceedings to Court where a resolution cannot be reached, communication has broken down or there are concerns with disclosure. This blog post looks at how to put on an initiating application for property matters.

 To file an Initiating Application for property matters you will need:

  1.  An initiating Application,
  2. A financial statement,
  3. An Affidavit, and
  4. The filing fee.

 These forms will set out what you are after and why.

 Nowadays you can file these documents online, send them to the Court via post or file them at Court in person.

 If you have a solicitor, they will need to think about:

  1.  Which Court your matter should be heard in,
  2. The feasibility and wording of the things you are seeking, and
  3. How best to explain your side of the story.
