Notice of Intended Distribution of Estate

Written by Naomi Webb | 29/01/17 10:04 PM

After going through the process of obtaining a Grant of Probate, you might be wondering why you have to publish another notice on the Supreme Court website.

Unlike the Notice of Intended Application for Probate or Notice for Intended Application for Letters of Administration, publication of this notice is not mandatory. The primary reason why executors and administrators may wish to publish such a notice is for personal protection. By personal protection, we mean protection from liability in future claims about which there was no knowledge of prior to the distribution of the estate.

Publishing this notice is the final chance for anyone wishing to make a claim on the estate. Once 30 days passes from the publishing of this notice, the estate is free to be distributed having regard to claims of which there was notice.
